Welcome to www.equihoof.com.au (the "Website"). The Website is owned and operated by Equihoof Pty Ltd], ABN 65 699 075 904, trading as Equihoof. ("we", "our" or "us"). By accessing or using the Website you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Website.
The hoof care services you book through the Website are delivered under a separate service agreement we provide at the time of booking. Where that agreement and these Terms cover the same subject, that agreement applies to the service and these Terms apply to the Website.
1. Acceptance of Terms
By using the Website you affirm that you are at least 18 years old and are fully able and competent to enter into and comply with these Terms. If you are using the Website on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. The content on this Website is general information
Everything published on the Website, including articles, guides, videos, downloads, photographs, diagrams and course material, is general information about hoof care. It is not advice about your horse, and it is not veterinary advice.
We are not registered veterinarians. Diagnosing disease, injury or a physiological or pathological condition in an animal, prescribing medication, administering anaesthetic and performing surgical procedures are acts reserved by law to registered veterinarians in every Australian state and territory. Nothing on the Website is a diagnosis and you must not treat it as one.
You are the owner or the person in charge of your horse, and under the animal welfare legislation of your state or territory you carry a legal duty to provide veterinary treatment when your horse needs it. Nothing on the Website replaces or reduces that duty.
Contact a registered veterinarian immediately, and before acting on anything you read here, if your horse shows lameness, acute pain, heat, a strong or bounding digital pulse, reluctance to move or bear weight, a rocked back stance, a wound, discharge, swelling, fever, or any sudden change in condition or behaviour. Laminitis, an abscess, a penetrating injury and a fracture are veterinary emergencies.
Every horse is different, and information that suits one horse can be wrong for another. You are responsible for deciding whether anything you read here is appropriate for your horse.
3. Your account
You are responsible for keeping your login details confidential and for everything done under your account. Tell us immediately at hello@equihoof.com.au if you believe your account has been used without your authority. We may suspend or close an account being used in breach of these Terms, and we will refund any amount you have paid for a period you have not received.
4. Purchases through the Website
Prices are in Australian dollars and include GST. Displaying a product or service on the Website is an invitation to purchase rather than an offer, and a contract forms when we confirm your order.
We take reasonable care to keep prices and descriptions accurate. Where an obvious error appears we may cancel the order and refund you in full rather than proceed at the wrong price.
Payment is taken through Paypal and their terms apply to the payment itself. Your full card details are not seen or stored by us.
5. Digital products, courses and memberships
When you buy a digital product or course through the Website, we grant you a personal, non-transferable licence to use it for your own horses. You may not copy, resell, share login details, upload it to a shared drive or group, or use it to advise or train other people commercially, and we may cancel access without refund if you do.
Unless we say otherwise at purchase you have access for 5 years. If we withdraw a product you have bought, we will give you at least thirty days notice so you can download or finish it.
Memberships are billed monthly in advance and renew automatically until you cancel, and we will remind you at least seven days before an annual renewal. If we change the price or remove a benefit we will give you at least thirty days written notice, you may cancel before the change takes effect without penalty, and a price change never applies to a period you have already paid for.
You can cancel at any time through your account or by emailing hello@equihoof.com.au , and cancelling is no harder than joining. Cancellation takes effect at the end of the billing period you have paid for and you keep access until then.
6. Refunds and your consumer rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For services, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value, if the service has a major failure. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time and, if this is not done, to cancel the contract and obtain a refund for the unused portion. For goods, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts or modifies those rights.
Separately from those rights, we do not refund change of mind on a digital product once it has been accessed or downloaded, or on a membership period already used. If something you bought has a problem, contact us at hello@equihoof.com.au and we will work with you to resolve it.
7. What you upload
When you upload photographs, video or information through the Website you keep ownership of it, and you grant us a licence to use it to deliver the service you have purchased and to keep your file, as set out in our Privacy Policy at www.equihoof.com.au/privacy-policy, which forms part of these Terms.
You confirm that the material is yours to upload, that the information you give us is accurate and complete, and that where images show other identifiable people you have told them and they do not object.
We use your material in marketing, teaching or published case studies only where you have given the separate written consent described in our Privacy Policy.
8. Use of the Website
You agree to use the Website in accordance with these Terms and all applicable laws. You may not:
Use the Website for any unlawful purpose
Attempt to gain unauthorised access to any portion or feature of the Website, or to any system or network connected to it
Use any device, software or routine to interfere with the proper working of the Website
Take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Website
Use any robot, spider, scraper or other automated or manual process to monitor or copy any of the pages, data or content on the Website
Use any part of the Website to build a competing product or service
Where you post a comment, review or contribution in a member space or community area, you are responsible for what you post, and you must not post anything unlawful, defamatory, misleading, abusive or that infringes another person's rights or privacy. We may remove content that breaches these Terms, and we will not remove an honest review because it is unfavourable. Where you give us a testimonial we may publish it with your first name and general location unless you tell us otherwise.
9. Intellectual property rights
All content, trade marks and data on the Website, including text, graphics, logos, icons, images, audio, video, downloads, course material, data compilations and software, are the property of Equihoof Pty Ltd or its content suppliers and are protected by Australian and international intellectual property laws.
You may view the content and print a copy for your own use. You may not copy, republish, sell or reproduce it commercially without our written permission.
10. Privacy
Your use of the Website is also governed by our Privacy Policy at www.equihoof.com.au/privacy-policy. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
11. Availability and other websites
We aim to keep the Website available and accurate, and we do not guarantee that it will be uninterrupted, error free or current at all times. We may change, suspend or withdraw any part of it, including content you have previously seen here.
The Website links to other sites and platforms we do not control, including social media, payment pages and course platforms. We provide those links for convenience and we are not responsible for their content, their products or their handling of your information.
12. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement, including liability for death or personal injury caused by our negligence or reckless conduct.
Subject to that, and to the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data, use or goodwill, resulting from:
Your use of, or inability to use, the Website
Your reliance on the general content published on the Website, including where you have applied it to your own horse
Your failure to obtain veterinary attention, or a delay in obtaining it
Any unauthorised access to our systems, or to any personal information stored in them
Any interruption or cessation of transmission to or from the Website, or the loss of anything you have uploaded
Any bugs, viruses or malicious code transmitted to or through the Website by a third party
Any error or omission in content made available through the Website, or any third party website we link to
Where our liability can lawfully be limited, our total liability is limited to the amount you have paid us through the Website in the twelve months before the claim.
13. Indemnity
You agree to indemnify us and anyone who works with us against all claims, losses, expenses, damages and costs, including reasonable legal costs, resulting from your breach of these Terms, from material you uploaded that you were not entitled to provide, from a claim by another person about material you uploaded that shows them or their property, or from any activity under your account.
This indemnity does not apply to the extent that the loss was caused by our own negligence, breach or wrongful act.
14. Changes to these Terms
We may revise these Terms from time to time, and the current version is always at www.equihoof.com.au/terms with the last updated date at the top.
Changes apply to purchases made after they take effect. Where you hold a membership or an active account, we will give you at least thirty days written notice of a change that affects you, and you may cancel before it takes effect without penalty.
15. Governing law
These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Western Australia for the resolution of any dispute arising out of or relating to these Terms or the Website.
If you have a problem, contact us at hello@equihoof.com.au first and we will respond within ten business days and work with you in good faith to resolve it.
16. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision is severed and the remaining provisions continue to apply. If we do not enforce a right straight away, we do not give it up.
